Restraining Orders

A domestic violence restraining order is a court order that helps protect you from abuse or threats of abuse by someone you have a close relationship with. While it cannot guarantee safety, it can provide important legal protections.

You May Qualify If:

  • Someone has abused or threatened to abuse you
  • AND you have a close relationship with them, such as:
    • Married or registered domestic partners
    • Divorced or separated
    • Dating or previously dated
    • Living together or previously lived together (more than roommates)
    • Parents of a child together
    • Close relatives (parent, child, sibling, grandparent, in-law)

A Restraining Order Can:

  • Require the person to stay away from you, your children, and your home
  • Prevent contact or harassment
  • Require them to move out of your home
  • Prohibit firearm possession
  • Establish custody and visitation orders
  • Require child support or bill payments
  • Mandate completion of a 52-week batterer intervention program

Custody

If you or your child has experienced abuse, a custody plan can help ensure safety and stability.

These plans clearly define:

  • Where the child lives
  • Visitation schedules
  • Decision-making authority

Custody orders can be customized to protect survivors and children.

divorce

Divorce

Survivors who are married to someone abusive may choose to end their marriage.

Divorce proceedings can also include:

  • Custody arrangements
  • Child and spousal support
  • Division of property

We help guide you through this process safely and clearly.

Paternity

Paternity cases establish who a child’s legal parents are.

  • If parents are married, parentage is usually automatic
  • If unmarried, legal parentage must be established

This is necessary before the court can make decisions about:

  • Custody
  • Visitation
  • Child support
